Lux Limo Service Ltd. - Comprehensive Service, Booking & Website Policy

Governing jurisdiction: Province of Alberta, City of Calgary

1. Definitions

"Company," "we," "us," and "our" mean Lux Limo Service Ltd., an Alberta corporation, Licence No. LLS-2025-YY.

"Client" or "you" means the individual or legal entity entering a booking.

"Vehicle" means any limousine, SUV (e.g., Cadillac Escalade ESV), sedan, or shuttle operated by the Company.

"Ride Time" means the continuously metered time from the scheduled pick-up to final drop-off, including wait times.

"Site" means www.luxlimo.ca and associated sub-domains.

Capitalised terms have the same meaning throughout this Policy.

2. Scope of Policy

This Policy forms part of every service contract, quotation, invoice, and online reservation. By booking with us or using the Site, you acknowledge acceptance of all provisions herein. Nothing in this Policy limits consumer rights that cannot legally be waived under the Alberta Consumer Protection Act.

3. Reservations & Deposits

3.1 Booking Window

Online booking closes 24 hours prior to service; phone bookings accepted up to 4 hours subject to availability.

3.2 Deposit

A non-refundable deposit of 25% of the quoted total (before GST) is charged at confirmation. For peak-demand events (Stampede week, corporate holiday season, graduations, major concerts), the deposit is 50%.

3.3 Security Hold

A pre-authorisation of CAD 250.00 (standard vehicles) or CAD 500.00 (stretch limos & specialty vehicles) is held on the credit card 48 hours before service and released minus incidentals within 72 hours after final drop-off.

3.4 Accepted Payments

Visa, MasterCard, American Express, corporate direct deposit, or e-Transfer. Cash may settle balances in-vehicle but cannot be used for deposits.

3.5 Contract Formation

A booking is firm only after (a) deposit received, (b) signed electronic agreement, and (c) confirmation email issued by the Company system.

4. Pricing, Fees & Overtime

4.1 Quoted Rates

Include chauffeur, basic vehicle preparation, fuel surcharge, and standard insurance.

4.2 Mandatory Taxes & Surcharges

5% GST plus any City of Calgary livery fees.

4.3 Overtime

Charged in 15-minute increments at 125% of the pro-rated hourly rate. Overtime commences after a 5-minute grace period beyond pre-booked Ride Time.

4.4 Tolls/Parking

Actual costs plus 10% administration fee are added to the final invoice.

4.5 Cleaning Fee

A minimum CAD 250.00 applies for biohazard incidents (vomit, blood, bodily fluids) or excessive debris.

4.6 Damage Fee

Cost of repair plus out-of-service revenue loss.

Rescheduling is treated as a cancellation plus a new booking unless confirmed in writing by an authorised manager.

6. Passenger Code of Conduct

6.1 Seat Belts

Required for all occupants per Alberta Traffic Safety Act, s.81.

6.2 No Smoking/Vaping

All vehicles are 100% smoke-free (tobacco, cannabis, e-cigarettes).

6.3 Behaviour

Violence, harassment, or intimidation toward staff or other passengers triggers immediate termination of service without refund and may involve police.

6.4 Capacity

Passenger numbers may not exceed the manufacturer's rated seating.

6.5 Prohibited Items

Firearms, explosives, fireworks, and hazardous chemicals are banned unless authorised by law and declared in advance.

7. Alcohol, Cannabis & Controlled Substances

7.1 Open Liquor

Permitted only where (a) the vehicle holds a valid AGLC Liquor-Licence-Vehicle-for-Hire endorsement, and (b) all passengers are 18+ and produce valid ID on request.

7.2 Self-Serve

Passengers may not self-serve unless the applicable licence class explicitly allows it; otherwise, service is provided by a ProServe-certified attendant.

7.3 Cannabis

Consumption of cannabis in any form is prohibited under GLCA while the vehicle is in motion or on a public roadway.

7.4 Illegal Drugs

Zero-tolerance; discovery results in ride termination and forfeiture of all payments.

8. Safety, Seat Belts & Child Restraints

8.1 Child Seats

Clients must provide CSA-approved child restraints; chauffeurs may assist installation but are not responsible for installation errors.

8.2 Road Conditions

In severe weather (e.g., blizzard, freezing rain) the Company may refuse service, reschedule, or alter routes for safety.

8.3 Driver Authority

Chauffeurs may refuse entry or require disembarkation of any passenger violating safety rules.

9. Service Limitations & Force Majeure

We are not liable for delays or non-performance caused by force majeure events, including but not limited to extreme weather, road closures, labour disputes, sudden mechanical failure despite preventive maintenance, public emergencies, or acts of God. Refunds or credits will be issued at the Company's sole discretion.

10. Vehicle Damage, Cleaning & Lost Property

10.1 Damage

The booking Client is financially responsible for damage caused by the Client or their party.

10.2 Inspection

Vehicles are photographed before and after each charter; discrepancies are documented.

10.3 Lost Items

We will hold items for 30 days; shipping charges or delivery fees apply. We are not liable for perishable, fragile, or high-value items left behind.

11. Privacy & Data Protection

11.1 PIPA Compliance

Personal information is collected for reservation processing and regulatory reporting in accordance with the Personal Information Protection Act (Alberta).

11.2 Storage

Data is stored on encrypted servers located in Canada.

11.3 Marketing Consent

We will not send promotional emails unless you opt in.

11.4 CCTV

Some vehicles use interior video for security; signage is posted as required by Bylaw 20M2021.

12. Insurance & Liability Limitation

12.1 Mandatory Coverage

All vehicles carry commercial automobile insurance with minimum CAD 2 million liability and accident benefits as mandated by the Insurance Act (Alberta).

12.2 Limitation of Liability

To the fullest extent permitted by law, the Company's liability is limited to direct damages up to the amount paid for the specific booking. We disclaim all consequential, incidental, or punitive damages.

12.3 Indemnity

The Client agrees to indemnify and hold the Company harmless from claims arising from the Client's breach of this Policy.

13. Complaints & Dispute Resolution

13.1 Internal Review

Submit written complaints to compliance@luxlimo.ca within 7 days. We respond within 10 business days.

13.2 Mediation

Unresolved disputes proceed to voluntary mediation under the Alternative Dispute Resolution Institute of Alberta (ADRIA).

13.3 Court

If mediation fails, the courts of Calgary, Alberta, have exclusive jurisdiction.

14. Website Terms of Service

14.1 Agreement to Terms

By accessing www.luxlimo.ca (the "Site"), creating an account, or booking ground-transportation services (collectively, the "Services"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not accept the Terms, you must immediately refrain from using the Site or booking our Services.

14.2 Eligibility

Age Requirement: You must be at least 18 years old (the age of majority in Alberta) and lawfully able to enter binding contracts.

Authority for Businesses: If you use the Services on behalf of a corporation or other entity, you warrant that you have authority to bind that entity and that "you," as used here, includes both the entity and its authorised users.

14.3 Account Registration & Security

Accurate Information: You agree to provide true, current, and complete information and keep it updated.

Credentials: You are responsible for maintaining the confidentiality of your login credentials. You must notify us immediately of unauthorised use or security breaches.

One Account Rule: You may maintain only one client account unless we approve otherwise in writing.

14.4 Permitted & Prohibited Use of the Site

Permitted Use: Viewing information, making legitimate reservations, communicating with us, and posting genuine reviews.

Prohibited Use: You shall not:

  • Use any robot, spider, or scraper without written consent
  • Transmit malware, ransomware, or any malicious code
  • Misrepresent identity or affiliation
  • Post defamatory, obscene, or infringing content
  • Attempt to gain unauthorised access to our servers or networks
  • Interfere with any other visitor's use of the Site

Enforcement: We may suspend or terminate accounts that violate these Terms or applicable law.

14.5 Intellectual Property

Ownership: All text, graphics, photos, video, trademarks, and code are owned or licensed by Lux Limo Service Ltd. and are protected by Canadian and international IP laws.

Limited Licence: We grant you a non-exclusive, non-transferable, revocable licence to view and print Site content solely for personal, non-commercial use related to booking our Services.

Restrictions: Except as expressly allowed, you may not copy, reproduce, modify, publish, distribute, create derivative works from, sell, or exploit any content without prior written consent.

14.6 User-Generated Content

Licence Grant: If you submit reviews, testimonials, photos, or other UGC, you grant us a perpetual, worldwide, royalty-free licence to use, reproduce, edit, translate, publish, and display such content in any media for promotional or operational purposes.

Accuracy & Ownership: You represent that you own or control the rights to all UGC you post and that it is accurate and not misleading.

Monitoring & Removal: We reserve the right (but have no obligation) to monitor, edit, or remove UGC at our discretion.

14.7 Third-Party Links & Integrations

The Site may contain links to third-party websites or services (e.g., payment processors, mapping APIs). These are provided "as is" for convenience. We do not endorse and are not responsible for their content or practices. Your dealings with third parties are solely between you and the third party.

14.8 Privacy & Cookie Use

Your submission of personal information is governed by our Privacy Policy. The Site uses functional cookies and similar technologies to save preferences, combat fraud, and analyse traffic. By using the Site, you consent to this use.

14.9 Disclaimers

Service Interruptions: The Site and Services may be unavailable from time to time due to maintenance, emergencies, or factors beyond our control.

No Warranty: To the maximum extent permitted by law, we provide the Site "as is" and "as available," without warranties of any kind, express or implied. Without limiting the foregoing, we disclaim warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Route & ETA Estimates: Any estimated travel times or routes displayed online are for reference only and not guaranteed.

14.10 Limitation of Liability

To the fullest extent permitted under Alberta law, Lux Limo Service Ltd., its directors, officers, employees, agents, and affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising from or relating to your use of (or inability to use) the Site or Services. Our total liability for any claim shall not exceed the greater of (i) CAD 100 or (ii) the amount you paid for the underlying booking.

14.11 Indemnification

You agree to defend, indemnify, and hold harmless Lux Limo Service Ltd. and its affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

  • Your breach of these Terms or the Policy
  • Your violation of any law or third-party right
  • Your UGC or misuse of the Site

14.12 Suspension & Termination

We may, with or without notice, suspend or terminate your access to the Site or Services if (a) you breach these Terms, (b) we suspect fraudulent or illegal activity, or (c) your account remains inactive for over 24 months. Clauses that by their nature should survive termination (e.g., Intellectual Property, Disclaimers, Limitation of Liability, Indemnification) will continue in effect.

14.13 Modifications to Terms

We may revise these Terms at any time. Material changes will be announced via (i) a prominent banner on the Site, or (ii) email to registered users. Your continued use of the Services after such changes constitutes acceptance of the updated Terms.

14.14 Entire Agreement

These Terms, together with the Service & Booking Policy, Privacy Policy, and any written booking confirmation, constitute the entire agreement between you and Lux Limo Service Ltd. concerning the Site and Services and supersede all prior communications.

15. Governing Law & Severability

This Policy is governed by the laws of the Province of Alberta and applicable federal laws of Canada. If any provision is held unenforceable, the remaining provisions remain in full force.
